Terms of Service

1. Acceptance of these terms

By creating an account, accessing or using MGH Books (the "Service"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, Data Policy, Refund Policy and Cookie Policy. If you do not agree, please do not use the Service. This is an electronic record under the Information Technology Act, 2000 and does not require a physical signature.

2. Who we are

The Service is provided by Mystical Home Decor Products, a sole proprietorship of Harsha Narayanbhai Luhar, with its place of business at B 1003 Diamond Sky, Adalaj, Gandhinagar 382421, Gujarat, India ("we", "us", "our"). Contact: support@mysticalglowhub.com · +91 78029 87794.

3. Eligibility & your account

• You must be at least 18 years old and capable of entering into a contract under the Indian Contract Act, 1872.
• You are responsible for the accuracy of the information you provide and for keeping your login credentials and licence key confidential.
• You are responsible for all activity under your account. Notify us promptly of any unauthorised use.

4. The service we provide

MGH Books is software that helps Indian businesses create GST invoices and manage billing, parties, items, inventory, expenses and accounting records, with features that vary by plan. We provide only the features actually described on our Plans page for the plan you hold. Feature availability may change over time as we improve the product; we will not materially reduce a paid feature you rely on without notice.

5. Plans, billing & renewals

• Paid plans are billed annually in Indian Rupees (₹). Prices and inclusions are shown on the Plans page and may include applicable GST.
• Payments are processed by our payment partner, Razorpay. By paying, you also agree to the payment partner's terms.
• A GST invoice for your subscription will be made available to you.
• We will endeavour to remind you before a renewal. You can choose not to renew at any time.

6. Free trial & Founders' Offer

We may offer a free trial or a promotional "Founders' Offer" (for example, a complimentary plan for a limited number of early users in exchange for feedback). Such offers are subject to any additional terms stated at the time, are limited in number and duration, are for genuine business use, are non-transferable and have no cash value, and may be withdrawn or modified by us. We will never auto-charge you for a paid plan without your express action.

7. Refunds & cancellation

Our refund and cancellation terms — including a 30-day money-back guarantee on paid annual plans — are set out in our Refund & Cancellation Policy, which forms part of these Terms.

8. Acceptable use

You agree not to:

• use the Service for any unlawful purpose, including tax evasion, fraud, money laundering, or creating false/fabricated invoices;
• upload unlawful, infringing or malicious content, or data you are not authorised to process;
• attempt to breach, probe or disrupt the security or integrity of the Service;
• resell, sublicense or white-label the Service except where your plan expressly permits it;
• reverse-engineer, copy or create derivative works of the Service except as allowed by law.

Misuse may lead to suspension or termination and, where applicable, reporting to authorities.

9. Your data & your responsibility

You own the business data you enter. We process it to provide the Service, as described in our Privacy Policy and Data Policy.

10. Intellectual property

All rights in the MGH Books software, branding, design and content (other than your business data) belong to us or our licensors. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your business during your subscription. The "MGH Books" name and logo may not be used without our permission.

11. Third-party services

The Service relies on third parties such as the payment gateway (Razorpay), hosting, web fonts and CDNs, and may integrate with government/utility APIs (e.g. GST, e-Way Bill, PIN-code lookup) where your plan offers them. We are not responsible for the availability, accuracy or acts of these third parties, which are governed by their own terms.

12. Disclaimers ("as is")

To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that results, reports or AI suggestions will be accurate or complete. Nothing in this clause affects rights you have as a consumer that cannot be excluded under the Consumer Protection Act, 2019.

13. Limitation of liability & data loss

To the maximum extent permitted by applicable law:

• We will not be liable for indirect, incidental, special, punitive or consequential losses, or for loss of profits, revenue, goodwill, business or anticipated savings.
• We will not be liable for loss or corruption of data to the extent it results from factors outside our reasonable control, from your own acts/omissions (e.g. clearing your browser, losing credentials, not keeping backups), or from third-party services.
• Our total aggregate liability arising out of or relating to the Service, from all causes, will not exceed the amount you actually paid to us for the Service in the 12 months immediately preceding the event giving rise to the claim (and, for free users, will be limited to ₹1,000).

14. Indemnity

You agree to indemnify and hold us harmless from claims, damages and reasonable costs arising out of your unlawful use of the Service, your breach of these Terms, or your violation of any law or third-party right (including the rights of persons whose data you process using the Service).

15. Suspension & termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, fail to pay, or use the Service unlawfully, or as required by law. On termination, your right to use the Service ends; we will, for a reasonable period, allow you to export your data, after which it may be deleted in line with our Data Policy.

16. Governing law & disputes

These Terms are governed by the laws of India. Subject to the dispute-resolution process below, the courts at Gandhinagar, Gujarat shall have exclusive jurisdiction. The parties will first attempt to resolve any dispute amicably; failing which, the dispute may be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996, seated at Gandhinagar, conducted in English. This clause does not deprive a consumer of any forum or remedy available under the Consumer Protection Act, 2019.
